LIVERPOOL FOOTBALL CLUB (the "CLUB") HOME MATCH

TICKET CONDITIONS OF ISSUE

 

1. Issue of Home Match Ticket

1.1 The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry.

1.2 Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

2. Admission to the Ground

2.1 Use of the Home Match Ticket constitutes acceptance of the Terms & Conditions of Entry.

2.2 A Home Match Ticket permits you to occupy at the Match the seat indicated on the Home Match Ticket or such other alternative seat of equal price as the Club may allocate to you at its reasonable discretion.

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Home Match Ticket in any subsequent Match or season.

2.4 Save as set out in clause 2.5 below, you shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Match or any aspect of it. Any person acting in breach of this provision may have such equipment confiscated and/or will be required to deliver up any tapes, films, disks or other recordings or data to the Premier League and/or the Club and the copyright in any such recording or transmission is herby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Premier League.

2.5 Mobile telephones are permitted within the Ground, provided that they are used for personal and private use only.

2.6 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

2.7 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

2.8 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

3. Use of Home Match Ticket

3.1 The Home Match Ticket is issued for your sole use and you shall not resell, assign or (save as set out in clause 3.3 below) transfer the Home Match Ticket or the benefit of it to any other person without the prior consent of the Club. The reference to reselling the Home Match Ticket includes reference to offering to sell a Home Match Ticket, exposing a Home Match Ticket for sale, making a Home Match Ticket available for sale by another and advertising that a Home Match Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Home Match Ticket may not be offered as a prize in any promotion or competition or transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service or used for any other commercial purpose save as expressly authorised by the PL or the Club.

3.2 The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that tickets are being sold illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities.  The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details).  We will use this to identify and prevent ticket touting offences and disorder at matches.

 

3.3 If more than one Home Match Ticket is issued to you one Home Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her personal use only PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the Guest as if he was the original purchaser of the Home Match Ticket (and you must inform the Guest of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club or any police officer. In the event that you and/or your Guest are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s) to a natural person who is known to you personally who would be entitled (under the Terms & Conditions of Entry) to purchase such Home Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the transferee as if he were the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club or any police officer.

3.4 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

3.5 Any Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Misuse of this Home Match Ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match and/or the cancellation and withdrawal of this Home Match Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Home Match Ticket.

3.6 There shall be no upgrades from a child concessionary ticket to an adult ticket under any circumstances.

3.7 On collection of ticket(s) from the Club's Ticket Office, the credit card used for payment must be produced along with name and address identification. If the cardholder is not collecting the ticket(s) a signed letter or a verified email (such email matching the email address of the cardholder on our database) from the cardholder must be produced giving authorisation to the person collecting.  The person collecting on the cardholder's behalf must also bring identification which confirms their name and address.  The person collecting on the cardholder's behalf may also be asked to answer certain security questions in relation to the cardholder. For the avoidance of doubt, in the event of any dispute, the Ticket Office Manager's decision is final.

3.8  The maximum number of Home Match Tickets which can be purchased on the Club's Telephone booking lines, from the Website or at the Club's Ticket Office window is FOUR (4) except as otherwise communicated by the Club from time to time for example with regards to a specific Match and/or competition in which the Club participates. This is regardless of the number of Fancards being quoted. If you wish to apply for a greater number of tickets you can apply via the group booking application procedure on the Website.

4. Changes to Match Dates & Refunds

4.1 Match dates may be subject to change from time to time for reasons beyond the Club's control (including, without limitation, television scheduling, cup competitions or postponement due to adverse weather conditions).  The Club reserves the right to reschedule any Match without notice and without any liability.  Where any Match is cancelled, abandoned or postponed, the Club shall not have any liability to you or your Guests, except that following any cancellation, abandonment or postponement of a Match you shall be entitled to attend the rearranged Match using the Home Match ticket purchased for the original Match date or via such application procedure as the Club shall publish on its Website as applicable.

4.2 Refunds of Home Match Tickets will only be granted if the Home Match Ticket is returned to the Club's Ticket Office no later than 14 days before the commencement of the Match.  Where a Match is cancelled, abandoned or postponed and subsequently rearranged a refund of Home Match Tickets will only be granted if the Home Match Ticket is returned to the Ticket Office no later than 14 days before the date of the original Match or by such later date as the Club may publish on its Website as applicable.  A refund will only be issued on production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt in the event of any dispute, the final decision belongs to the Ticket Office Manager.

5. Lost or Stolen Home Match Tickets

5.1 In order to gain admission to the Ground the Home Match Ticket must be presented in its entirety at the Match.

5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.

6. Cancellation & Withdrawal of Home Match Ticket

 

 

6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:

6.1.1 smoking in designated non-smoking areas;
6.1.2 persistent standing in seated areas whilst the Match is in progress;
6.1.3 sale or transfer (save as permitted) of this Home Match Ticket to any person;
6.1.4 deliberate misuse of the Home Match Ticket;
6.1.5 any misrepresentation in relation to clause 1.2;

6.1.6 the use of foul, obscene, abusive, racist and/or discriminatory language and/or gestures;
6.1.7 persistent swearing during the Match;
6.1.8 the throwing of any object within the Ground without lawful authority or excuse;

6.1.9 the chanting and/or shouting of anything of an indecent, discriminatory or racist nature;
6.1.10 the supply of any misleading or incorrect information in any application;

6.1.11 being (or appearing to be) drunk or intoxicated;

6.1.12 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of a Home Match Ticket.

6.2 In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion.

7. Exclusion of Liability

 

 

7.1 Except in respect of death or personal injury resulting from any negligence of the Club , neither The Liverpool Football Club and Athletic Grounds Limited nor any of its officers, employees or agents shall be responsible for (whether in tort, contract or otherwise):
(i) any loss, damage or injury to you and/or any Guest or to any property belonging to you or any Guest in or upon or around the Ground or any car park, resulting from any cause whatsoever;
(ii) for any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; and/or
(iii) any losses arising from any cancellation, postponement or rearrangement of a Match in accordance with Clause 4 including but not being limited to any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

7.2 Neither the PL nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

8. Governing Law

8.1 These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.

9. Miscellaneous

9.1 We reserve the right to change these Conditions of Issue from time to time and shall publish any such changes on our Website.


9.2 If any of these terms and conditions is determined by a competent authority to be invalid, unlawful or unenforceable to any extent, they shall, to that extent, be severed from the remaining terms and conditions which shall continue to be valid to the fullest extent permitted by applicable laws.

9.3 Notwithstanding any other provision in these Conditions of Issue and with the exception of FIFA, UEFA, The FA, PL and the Football League, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue.  Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

10. Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

"Conditions of Issue" means these terms and conditions governing the issue and use of a Home Match Ticket.

"Ground" means the football Ground and all other locations owned, occupied or utilised by the Club.

"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are enclosed).

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms and Conditions of Entry.

"Match" means any home football match in which the Club participates and that takes place at the Ground.

"Home Match Ticket" means a printed paper ticket or other form of ticket (and/or any rights arising out of or in connection with the foregoing) for admission to a Match.

"Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association, The Premier League ("PL"), and The Football League; the Ground Regulations; and the Conditions of Issue.

"Website" shall mean the Club's website at www.liverpoolfc.com

1.1 The issue of an Away Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry.

1.2 Away Match Tickets are for the use of supporters of the Visiting Club only. By applying for the Away Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Visiting Club.

2. Admission to the Ground

2.1 Use of the Away Match Ticket constitutes acceptance of the Terms & Conditions of Entry.

2.2 An Away Match Ticket permits you to occupy at the Match the seat indicated on the Away Match Ticket or such other alternative seat of equal price as the Club may allocate to you at its reasonable discretion.

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Away Match Ticket in any subsequent Match or season.

"Visiting Club" means the football club playing against the Club.

"Website" shall mean the Club's website at www.liverpoolfc.com

  1. INTRODUCTION

 

 

  1. Scope

 

The following 2018 UEFA Champions League™ Final Finalist Ticketing terms and conditions (the “Terms and Conditions”) are designed to ensure a fair, correct and efficient process for the purchase and use of Tickets to the 2018 UEFA Champions League™ Final by the supporters of the Finalist club (referred to herein after as the “Ticket Holders”). The sale and use of such Tickets are subject to the following Terms and Conditions and any other applicable laws or regulations (as defined below under “Regulations”) pertaining to access and usage of the NSC Olimpiyskiy in Kyiv.

 

  1. Definitions

 

Applicant

any natural person over 18 years of age with legal capacity to apply and enter into an agreement for purchase of the Tickets to the 2018 UEFA Champions League™ Final via the Finalist in accordance with these Terms and Conditions.

Guest

an individual accompanying the Applicant to the Match to whom Tickets may be transferred in accordance with these Terms and Conditions.

Host Association        

the Football Federation of Ukraine, with its registered office at Laboratorniy by-street, 7-a, 01133, Kyiv, Ukraine, which is responsible for the organisation and staging of the Match in Ukraine. For the avoidance of doubt, the Host Association is deemed to be the “organiser” of the Match under the applicable law.

Match 

the 2018 UEFA Champions League Final due to be held at the Stadium on 26 May 2018 (or on such other date/location as notified by UEFA).

Finalist

the relevant club, qualified for the 2018 UEFA Champions League™ Final and duly authorised by UEFA to implement and be responsible for a sales and distribution process for the Tickets it has been allocated by UEFA.

Regulations    

means, without limitation, the terms of the following:

 

  • Laws of Ukraine;

 

  • Stadium Regulations; and/or

 

  • UEFA and Host Association’s statutes and regulations applicable for the Match.

Stadium

the entire premises of the NSC Olimpiyskiy at Velyka Vasylkivska St, 55, Kyiv, Ukraine, 02000 at which the Match is scheduled to be held, including all areas which require a Ticket (or hospitality pass, if applicable) to gain access.

Stadium Owner

the owner of the Stadium and any operator or lessee of the Stadium.  

Stadium Regulations

the Stadium Regulations as applicable  to the Match which can be accessed at:

www.uefa.com/kyiv 

Ticket 

the paper or plastic ticket held by the Ticket Holder which (subject to these Terms and Conditions) grants the Ticket Holder the right to attend the Match and occupy a seat at the Stadium as indicated on each such Ticket.

Ticket Holder  

any person who is in actual and legitimate possession of a Ticket from the Finalist’s allocation including, without limitation, Applicants and Guests (as applicable).

UEFA

Union des associations européennes de football whose offices are located at Route de Genève 46, 1260 Nyon 2, Switzerland and any wholly owned subsidiary thereof, including but not limited to, UEFA Events SA.

 

  1. SALE OF TICKETS

 

  1. General Application Rules

 

  1. The Finalist is responsible for the implementation of the sales and distribution of Tickets to the Finalist’s supporters in accordance with these Terms and Conditions. UEFA and/or the Host Association shall not be held liable for any claims or issues arising from the sale and distribution process implemented by the Finalist.

 

  1. Applicants may apply for Tickets to the Match through the Finalist and in accordance with the application rules set out herein and as otherwise communicated to the Applicant by the Finalist. The Applicant must fully respect all steps of the sales and distribution process implemented by the Finalist as communicated to the Applicant together with these Terms and Conditions.  Applicants may apply to the Finalist for Tickets in such categories as identified to Applicants by the Finalist during the Finalist’s application and sales process.

 

  1. Subject to Article 3.4, each Applicant can apply for a maximum of four (4) Tickets. The Finalist and its agents reserve the right to cancel or reject any application at their sole discretion and any false applications may be subject to contractual and criminal sanctions. 

 

  1. Any Applicant who has purchased or been allocated Tickets for the Match via any other method (including but not limited to Tickets purchased and allocated via UEFA’s general public Ticket sales) cannot place an application with the Finalist which would, if successful, result in him/her being allocated more than four (4) Tickets in total for the Match.

 

  1. The Applicant acknowledges that any order which results in the Applicant exceeding the Ticket purchase limits identified in Article 3.4 shall be cancelled in full.

 

  1. At the time of applying for Tickets from the Finalist, all Applicants and Guests must provide the following personal details: surname, first name, date of birth, nationality and Passport or ID number. The Applicant warrants that such information is complete and accurate at all times.

 

  1. Tickets will be distributed to the successful Applicants by the Finalist in accordance with the rules communicated to the Applicants together with these Terms and Conditions.

 

  1. Tickets shall remain the property of UEFA at all times.

 

  1. USE OF TICKETS

 

  1. Prohibited Use of the Ticket(s)

 

  1. Except as expressly permitted in Article 4.2, any resale, transfer of Ticket(s), offer or advertisement of Ticket(s) for resale or transfer, whether for free or for consideration, is strictly prohibited.

 

  1. Applicants shall be permitted to transfer Tickets to their Guest(s), provided that (jointly):

 

  1. the Applicant will attend the Match together with his/her Guest;

 

  1. the Tickets are for their personal use;

 

  1. such permitted transfer is free of any extra consideration over and above the face value of the Ticket; and

 

  1. Guests, by accepting the transfer of Tickets from the Applicant, agree to be subject to these Terms and Conditions.

 

  1. The Ticket(s) shall not be:

 

  1. used for any promotion, advertising, fundraising, auction, raffle or any other similar commercial or non-commercial purposes;

 

  1. used as a prize (or part of a prize) in any contest, competition, (promotional) game of chance, lottery or sweepstake;

 

  1. combined with and sold as part of any package of goods or services; or

 

  1. combined with and sold as part of any travel or hospitality package (for example combining flights, hotels and the Ticket(s)).

 

  1. Ticket Holders shall not:

 

  1. run any advertisements or promotions relating to UEFA, the UEFA Champions League™ or the Match;

 

  1. advertise, promote, give away, distribute, sell or offer for sale any product or service from any part of the Stadium or via the display of overt commercial messages on clothing worn or items brought into the Stadium; or

 

  1. exploit any marketing or promotional opportunities in relation to the Ticket(s).

 

  1. For the avoidance of doubt, no branding, which may be aimed at promotional or marketing purposes whatsoever, may be displayed by any Ticket Holder at the Stadium.

 

  1. Ticket(s) acquired or used in breach of Article 4 and/or Article 9 of these Terms and Conditions shall be void and any person seeking to use such Ticket(s) will be deemed a trespasser and will be refused entry or be evicted from the Stadium, and may be liable to further legal action. Any unauthorised sale or transfer of the Ticket(s) may be reported to the police.

 

  1. Entrance to the Stadium

 

  1. Access to the Stadium will be permitted during such hours as specified on the Ticket or as published on UEFA’s website at www.uefa.com.  

 

  1. Entrance to the Stadium shall be:
  1. subject to compliance with:
    1. these Terms and Conditions;
    2. the Stadium Regulations;
    3. all applicable laws (whether statutory or otherwise and including health and safety requirements) governing access or presence at the Stadium, attendance at the Match, use of the Tickets, general safety certificate and any special safety certificate applying to the Stadium, issued by any authority that has jurisdiction or authority in relation to the holding of the Match at the Stadium; and
  2. authorised upon presentation of a valid Ticket per person (regardless of age) and, upon request, proof of identity with valid photograph (passport or national identity card). Ticket Holders leaving the Stadium will not be re-admitted.

 

  1. Conduct at the Stadium

 

  1. For safety and security purposes, all persons attending the Match, if and when so requested by stewards, safety personnel and/or any other legally authorised persons representing the organiser of the Match, shall:

 

  1. produce a valid Ticket together with proof of identity with valid photograph (passport or national identity card) in order to provide satisfactory evidence that the Ticket Holder’s identity corresponds to that of the Applicant/Guest whose data was provided to the Finalist;
  2. submit to inspections, body checks and examinations (including through the use of technical aids) to ensure that they are not in possession of dangerous, prohibited or unauthorised items. Safety personnel, stewards or police shall be entitled to search any person’s clothing and his/her belongings; and
  3. comply with all instructions and guidelines issued by safety personnel, stewards and/or police and/or any other duly authorised persons at the Stadium.

 

  1. The Stadium Regulations contain detailed lists of prohibited items and conduct and each Ticket Holder shall fully comply with any restrictions contained therein. Abbreviated version of the Terms and Conditions and/or Stadium Regulations, or simple icons illustrating prohibited items or conduct, may also be included on the Ticket and must be fully complied with by the Ticket Holder.

 

  1. Without limitation, it is strictly forbidden to do any of the following inside the Stadium:
    1. occupy or access areas which are closed to the public or for which access is unauthorised in accordance with the relevant Ticket category held by the Ticket Holder;
    2. restrict or loiter in areas open to traffic, footpaths and roadways, entrances and exits to visitor areas and emergency exits; and/or
    3. engage in any other conduct which may endanger any person at the Stadium.

 

  1. Fans supporting the teams participating in the Match may not be segregated at the Stadium and each Ticket Holder will be required to behave responsibly and in line with the safety and security guidelines communicated by UEFA, the Host Association and/or the Stadium Owner.

 

  1. Sound and Image Recordings
    1. Ticket Holders attending the Match at the Stadium, consent to being photographed, filmed or taped by UEFA, the Host Association and/or the Stadium Owner, and/or any third parties appointed thereby, which shall have the right to use, broadcast, publish and license, without any requirement for payment of money or other form of consideration, of Ticket Holder’s voice, image and likeness by means of live or recorded video and/or audio display, broadcast or other transmission or recording, photographs or any other current and/or future media technologies.
    2. Ticket Holders shall not take, record and/or transmit any sound, image and/or description of the Stadium or the Match (as well as any result and/or statistics of the Match) other than for his/her exclusive, private and domestic use (which, for the avoidance of doubt and by way of example only, shall not include recording and/or transmitting any sound, image and/or description of the Stadium for any commercial purposes). It is strictly forbidden to disseminate over the Internet, radio, television or any other current and/or future media, any sound, picture, image, data, description, result and/or statistics of the Match in whole or in part, or to assist any other person(s) conducting such activities.  Copyright, database rights and any other intellectual property rights in any unauthorised recording or transmission under this clause is assigned (by way of present assignment of future rights) to UEFA. Ticket Holders further agree (if and whenever required to do so by UEFA) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to UEFA absolutely and free of all encumbrances and other charges.
  1. MISCELLANEOUS

 

  1. Liability
    1. In the event that the Finalist, UEFA, the Host Association and/or the Stadium Owner is in breach of their obligations (under these Terms and Conditions or otherwise), the Finalist, UEFA, the Host Association and/or the Stadium Owner shall only be responsible for such loss or damage suffered by the Ticket Holder which was reasonably foreseeable as a result of the breach.  The Finalist, UEFA, the Host Association and/or the Stadium Owner shall not be responsible for any loss or damage that is not reasonably foreseeable or contemplated at the time the Applicant entered into a contract pursuant to these Terms and Conditions.
    2. Notwithstanding Article 8.1, the Finalist, UEFA, the Host Association and/or the Stadium Owner is not liable for any business losses and the Finalist, UEFA, the Host Association and/or the Stadium Owner will have no liability to any Ticket Holder for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    3. In any event, to the maximum extent permitted by law, the Finalist, UEFA, the Host Association and/or the Stadium Owner hereby exclude any liability for loss, damage or injury to a Ticket Holder and/or their property, including (but not limited to) any indirect or consequential loss or damage, including (but not limited to) loss of enjoyment or travel or accommodation costs, regardless of whether the loss or damage: (a) would arise in the ordinary course of events; (b) is reasonably foreseeable; or (c) is in the contemplation of the parties, or otherwise.
    4. The Finalist, UEFA, the Host Association and/or the Stadium Owner shall not be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.
    5. Notwithstanding any provision in these Terms and Conditions, the Finalist, UEFA, the Host Association and/or the Stadium Owner does not seek to exclude or limit their liability: (a) for fraud or fraudulent misrepresentation; (b) for death or personal injury caused by the Finalist’s, UEFA’s, the Host Association’s and/or the Stadium Owner’s negligence or the negligence of any of their officers, employees or agents; or (c) for any other matter for which it is not possible to exclude or limit liability by law.
    6. Nothing stated or implied in these Terms and Conditions will affect the Ticket Holder’s statutory rights.

 

  1. Unauthorised Spectators

 

  1. Ticket Holders are permitted to attend the Match only provided that they are not an Excluded Person and provided that the transfer of the Ticket to the Guest (if applicable) is made subject to and in accordance with Article 4.2 of these Terms and Conditions.

 

  1. For the purpose of this Article 9 “Excluded Person” means:
  1. any person banned by the Host Association from membership of the fan club for the national football team, or The Football Association (or banned from any equivalent official supporters club by a football governing body in any jurisdiction in the World);
  2. any person subject to a football banning order pursuant to a conviction under the Law of England and Wales;
  3. any person banned by UEFA, FIFA, any football governing body, from travelling to or attending any association’s football match;
  4. any person banned by UEFA, the Host Association and/or the Stadium Owner from attending events at the Stadium;
  5. any person who is deemed by the participating clubs in the Match to be a person to whom Tickets should not be allocated (including but not limited to persons who have been issued with a stadium ban by the respective participating club); and
  6. any person who has breached or is in breach of these Terms and Conditions.

 

  1. Data

 

  1. Applicants acknowledge and agree to their personal data, and the personal data of their Guest(s) (as provided to and collected by the Finalist pursuant to these Terms and Conditions) being processed by the Finalist and transferred to UEFA and that such personal data will be entered into a database owned by UEFA for the purposes of the organisation and running of the Match (in particular in connection with the Ticket sales and/or any relevant safety and security measures). 
  2. Applicants acknowledges that UEFA may transfer the Applicant’s personal data and the personal data of his/her Guest to the Host Association and/or the Stadium Owner (and their agents), for the purposes set out above. Furthermore, provided that the Applicant has specifically granted his/her consent during the Finalist’s Ticket application process, his/her personal data can be used to provide him/her (and his/her Guest) with information on products, services, commercial activities and events of UEFA and/or its commercial partners.
  3. The personal data of Ticket Holders provided to UEFA pursuant to these Terms and Conditions is only collected and processed by UEFA for no longer than is necessary for the purposes described in Articles 10.1 and 10.2, unless the use of such personal data is further required for ongoing administrative or judicial proceedings relating to the Match and any other match(es) organised and run by UEFA.
  4. Applicants and Guests can request a copy of their personal data held by UEFA and ask for any such data to be corrected by writing to: UEFA, Route de Genève 46, 1260 Nyon 2, Switzerland, marked “For the attention of Legal Department (Personal Data Request 2018 UCL Final)”. The provision of such information will be subject to verification of the Ticket Holder’s identity.
  5. Each Ticket Holder shall acknowledge and agree at the time he or she receives the Ticket from the Finalist that they have understood, accepted, and will conform to this Article 10.

 

  1. Unforeseen Circumstances

 

  1. UEFA, the Host Association and/or the Stadium Owner reserve the right to make alterations to the time, date and location of the Match due to unforeseen extraordinary circumstances: force majeure, safety and/or security reasons or other decisions made by any competent authority which have a major impact on the Match being played at the Stadium.

 

  1. In the event of cancellation, abandonment, postponement or replaying of the Match, Article 8 of these Terms and Conditions shall apply and:
    1. the Ticket will allow entry to the rearranged Match; and
    2. subject to the foregoing and Article 8, the Finalist, UEFA, the Host Association and/or the Stadium Owner will not have any liability to the Ticket Holder on account of any such cancellation, abandonment, postponement, replay or other failure or deficiency in the conduct of the Match.

 

  1. Severability and Amendment

 

  1. UEFA reserves the right to change these Terms and Conditions if necessary to ensure proper and safe staging of the Match at the Stadium.  The Finalist will notify the Ticket Holder of such changes if they materially affect the Ticket Holder’s rights as a consumer and the Ticket Holder will have the choice to consent to such changes or to refuse to accept the Ticket(s) (and if already in possession of the Ticket(s), return the Ticket(s) to the Finalist) and thus not to be bound by the amended Terms and Conditions.

 

  1. Should any provisions of these Terms and Conditions be declared void, ineffective, illegal or unenforceable by any competent court, regulator or authority, the remainder of these Terms and Conditions shall remain in effect as if such void, ineffective, illegal or unenforceable provision(s) had not been included.

 

  1. Authentic Text

 

  1. These Terms and Conditions have been drafted in the English language. In the event of any discrepancy between the English and any translated version, the English version shall prevail.

 

  1. General

 

  1. Each Applicant consents to these Terms and Conditions for themselves and on behalf of their Guest(s) (i.e. the Applicant shall ensure that their Guest(s) understand(s), agree(s) and will comply with these Terms and Conditions).

 

  1. These Terms and Conditions constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Terms and Conditions which is not already set out in these Terms and Conditions.

 

  1. These Terms and Conditions are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising under or in connection with these Terms and Conditions.
