1.1 If you hold a ticket for a Match you may release your seat from your ticket for sale through the Ticket Exchange system. The Ticket Exchange does not apply and you may not release any seat that has been purchased in any local general sale. 1.2 If you are unable to attend a Match you can put your seat(s) up for sale by logging into your ‘My Account’ and selecting the Ticket Exchange option. We do not guarantee that your released seat will be sold.1.3 The Club will decide which Matches are eligible for the Ticket Exchange in our sole discretion.1.4 If your seat is sold then it will be sold for the face value of the ticket. 1.5 If you are returning either an Adult/Junior Ticket or a Disabled/PA ticket, these tickets must be returned as a pair.1.6 Once you have submitted your seat for resale, you can check the status of your seat on your My Account to see if your seat has sold. If your seat has been sold, you will not be able to attend that Match and your ticket (in whatever form) will be deactivated for that Match. You will receive email confirmation that the seat has been sold. 1.7 If your seat has not been sold within 3 hours of kick-off and you want to attend the Match, you still have the option to remove your seat from the Ticket Exchange and attend the Match yourself. 1.8 Dependent on the refund method you indicate when putting your seat up for sale on the Ticket Exchange, the Club will either hold the value of any seat(s) you sell via the Ticket Exchange in your Ticket Cash Account or it will be paid directly to your bank account within 20 working days of the Match being played. No changes can be made to your indicated refund method.

1. Selling a ticket via Ticket Exchange

2.1 The Club provides you with access to the Ticket Exchange system on an "as is" basis and make no representations or warranties of any kind with respect to the Ticket Exchange system or its content including (without limitation) implied warranties as to completeness, accuracy, satisfactory quality and fitness for a particular purpose, except to the extent required by law.2.2 The Club does not warrant that the Ticket Exchange system will meet your particular requirements or that it will be uninterrupted, timely, secure or error-free, nor do we make any warranty as to results or the accuracy of any information obtained by the Club through the Ticket Exchange system, except to the extent required by law.

2. Disclaimer of Warranties 

Please note that the Club gives no guarantees that any Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match or, if necessary, play any Match out of view of the public without fans in attendance or at a reduced capacity, without notice and without any liability whatsoever. If a Match is rescheduled and your seat was already sold for the original date and time of the Match you shall not be entitled to attend the rearranged Match.

3. Cancellation of a Match and Refunds

The Club may suspend, terminate or refuse to grant you access to the Ticket Exchange system at any time in its absolute discretion. Circumstances in which the Club is likely to exercise our discretion include, without limitation, if: (a) your use of the Ticket Exchange system is considered abusive, excessive, or against the interests of other users, or in breach of these terms and conditions; (b) your ticket expires or is terminated for any reason; or (c) a competent regulatory authority requires all or any part of the Ticket Exchange system to be suspended or terminated.

4. Suspension and Termination

From time to time, the Ticket Exchange system may be closed down in order for work to be carried out relating to the upgrading or maintenance of the Ticket Exchange system or necessary for the provision of the Ticket Exchange system.

5. Maintenance of the Ticket Exchange System 

We refer you to our Privacy Policy terms and conditions (https://www.liverpoolfc.com/legal/privacy-policy) for more information on our privacy policies and use of personal data. The Privacy Policy terms and conditions in force from time to time are incorporated into these Terms and Conditions.

6. Data Protection

7.1 Except in respect of death or personal injury resulting from any negligence of the Club, neither the Club nor any of its officers, employees or agents shall be responsible for (whether in tort, contract or otherwise):(i) for any loss of profit, loss of revenue, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; and/or(ii) any losses arising from any cancellation, postponement or rearrangement of a match including but not being limited to any loss of enjoyment or travel/accommodation costs.

7. Exclusion of Liability

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales (including in relation to any non-contractual disputes or claims).

8. Governing Law

9.1 The Club reserves the right to change these Terms and Conditions from time to time and shall publish any such changes on the Club website.9.2 If any of these Terms and Conditions is determined by a competent authority to be invalid, unlawful or unenforceable to any extent, they shall, to that extent, be severed from the remaining terms and conditions which shall continue to be valid to the fullest extent permitted by applicable laws.9.3 No other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms and Conditions. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

9. Miscellaneous

“Club” means The Liverpool Football Club and Athletic Grounds Limited."Ground" means the football Ground and all other locations owned, occupied or utilised by the Club.“Match” means any home football match in which the Club participates and that takes place at the Ground during Season 2021-2022 as designated upon the ticket to which these Terms and Conditions apply.“Ticket Cash Account” means your ticket cash account within your My Account area.“Ticket Exchange” means the Club’s official authorised ticket resale facility.
